The person who retains capacity always has the right to change their ADRT. Remember, this ADRT only applies when a person loses capacity. A valid and applicable “real time” decision always overrides a previous (inactive) ADRT.

A person is always allowed to change their mind. If there is any reasonable doubt about any such decision senior advice should be sort.

As a professional you are there to help with the consequences of this change, despite it being the person’s primary responsibility.

Avoid mistakes by clear communication and documentation.
