 Is an ADRT legal?
Three Basic Rules: An ADRT has to:
  1. Exist
  2. Be Valid
  3. Apply to the circumstances outlined eg refuse a specific treatment in the event of a predicted and described situation and an ADRT only becomes active when mental capacity is lost.
Anyone involved with people with an ADRT should always test any situation against these criteria. If it is an ADRT relating to life sustaining treatment it must comply with the required format and be in writing.

  • In the presence of a valid and applicable ADRT, actions contrary to this ADRT may be liable to civil or criminal proceedings
  • If there are genuine doubts about the existence, validity or applicability, treatment can be provided (if professionals can demonstrate that this belief was reasonable)
