Advance Decisions to Refuse Treatment
  1. Must specify the treatment that is to be refused
  2. May set out the specific circumstances in which the refusal will apply
  3. An advance decision will only apply at a time when the person lacks capacity to consent to the specified treatment
Remember
  • Advanced refusal of treatment only applies when a person loses capacity.
  • A new valid and applicable decision always overrides previous advance refusal.
A person is always allowed to change their mind.
