Key Definitions
  • An Advance Decision to Refuse Treatment (ADRT) is a clear set of instructions, on the declining, withholding or withdrawing of treatment in the future, given whilst the person still has mental capacity and in contemplation of the loss of such faculties in the future.
  • An ADRT only becomes active if the person has lost capacity. Otherwise the normal consent process applies
  • ADRT from October 2007 replaces “Living Wills and Advance Directives” Anybody with an existing Living Will or Advance Directive will have to ensure it complies with the new standards in order to ensure validity and applicability.
  • The making of an ADRT is entirely voluntary and people should not be coerced by anybody into this decision. This is quite different to informing people of this choice. Circumstances need to be judged in a sensitive manner and on an individual basis before concepts of ADRT are introduced.
