Background
The Mental Capacity Act 2005 was implemented in two phases. Advance Decisions to Refuse Treatment (ADRT) came into force in October 2007. ADRT should be viewed as part of Advance Care Planning, underpinned by Good Clinical Practice and National End of Life Strategy Guidance 2008 . The Mental Capacity Act Code of Practice tells us how to implement this process. This must be followed as by not doing so might lead to prosecution. It is a matter of individual choice as to whether or not a person wishes to make an ADRT. This is entirely voluntary. An ADRT can be made at any time when envisaging a future loss of capacity.
